Please be aware that these Terms and Conditions, may be modified and amended from time to time, sets forth the terms on which:

a) CARLOS TOURS (E-SERVICE), located at Kolokotroni 103, Pefki 12151, Athens, Greece (“TukTukAthens”, “We”, “us” or “our”) provides services (“Services”) through its proprietary marketplace platform accessible via the www.tuktukathens.com website and subdomains (the “Site”) and/or over the phone and/or by email;

b) to any person (“You”) that accesses the Site and/or uses our Services, which includes booking tours and related services (the “Tours”).

When You access the Site and(or use our Services, You hereby represent and warrant that:

1. You have read, understand, and agree to comply and be bound by these Terms and Conditions.
2. You are an individual at least 18 years old or a duly organized, validly existing business, organization or other legal entity in good standing under the laws of the country in which You are established.
3. You are able to enter into legally binding contracts.

If You do not agree to be bound by these Terms and Conditions, You may not access and/or use the Site and/or our Services and should immediately leave the Site. 

Please read them carefully as they set out our respective rights and obligations. By asking us to confirm your booking, we are entitled to assume that you have had the opportunity to read and have read these terms and conditions and agree to them.

These terms and conditions outline the rules and regulations for the use of CARLOS TOURS E-SERVICE, under the domain https://tuktukathens.com.

We operate the Site, which is an online travel agency and allows You to search and book our tours, post reviews and process payments.

You may search our Tours and other Experiences from other tour operator companies from which we only recommend their services, it will depend to You if you purchase their services.

Once You decide on a specific Tour, You may connect and conclude contracts directly and through our Site.

If you decide on a specific experience from other tour operator you will be inmediately re-directed to their site and you will be bound to their terms and conditions and their policies.

We are constantly updating our Site and its functionalities. Therefore, We may modify and/or delete any functionality our service on the Site and/or introduce new ones from time to time.

The Site lists many Tours from our own property, you can find them on the page with the title "Tours", each Tour contains a description of the characteristics and items included, such as description and itinerary (“Tour Terms”). You may send us a message any inquiry about a certain Tour or to request a customized Tour. You may also choose to make a booking request for a particular Tour by clicking the “Book Now” button, or any other button as may be modified.

You shall review the Tour Terms before making a booking our a reservation. Once your booking request is accepted, You will be bound by the Tour Terms. These Terms and Conditions will prevail over the Tour Terms with respect to your relationship with TukTukAthens.

You understand and agree that due to the ongoing disruptions related to the Covid-19 pandemic the Tours itineraries may be subject to changes that are out our control. You agree that only changes that substantially impact the Tour itinerary will entitle You to cancel such Tour without cost.

You can see all prices directly on the page of each tour, which fully compensates our services. Prices may change without prior notice until a booking has been made. Tour Prices include all taxes.

You will ensure that any and all payments are processed through the Site whenever possible, or such other means as TukTukAthens may determine.

You will make payment of bookings by credit card or other form of payment available through the Site. We do not store credit card information. TukTukAthens uses a third party service to process your payment information for all transactions made through TukTukAthens. You authorize TukTukAthens and its payment service partners to process your payments. These payment processing services are governed by the terms and conditions of those third party services and will apply to the payments You make through their system. 

Each Tour is displayed in its default currency. You may choose to pay for a Tour in other currencies available on the Site. You may select another currency when You search for Tours or make a booking request. Once You book a Tour, the Tour Price is fixed in such currency, even if exchange rates fluctuate between the time You book and the time You take your Tour. The exchange rates that the Site uses to convert Tour prices are set based on currency information services companies. Your bank or credit card company may apply different commissions and charges when selecting a currency other than your local currency.

TukTukAthens may cancel any booking, in its sole discretion, if We believe in good faith that such cancellation is necessary to prevent or reduce any damages to any user of the Site and/or to TukTukAthens. We will reimburse and/or refund You in accordance with the reasons for cancellation. 

Refunds will be sent back to the original payment method used in making the booking. Depending on the bank's processing time, it can take 10 business days for the refunds to reflect in your bank account or card balance.

TukTukAthens is not responsible for any incidental expenses You and/or any other participant may have directly or indirectly incurred as a result of the booking of a Tour. These expenses include, but are not limited to, the cost of visas, accommodation, vehicle rental, vaccinations, flights and/or loss of enjoyment.

2. You will receive a full refund of the tour price if You cancel at least 24 hours before the start date of the tour. Timing is calculated in accordance with the time zone of the tour.

You may receive a refund of the tour price if You are prevented from taking the tour because of an unforeseeable event that is out of your control and shows up after the booking (“Unforeseeable Events”). The determination of what constitutes Unforeseeable Events is at the discretion of TukTukAthens.

The following is a list of examples of what we consider as Unforeseeable Events or Force Majeure Events:

(a) Impersonal events that make it dangerous or impossible to safely undertake a tour, such as: travel restrictions imposed by governments, epidemic disease unusual to an area, war, civil insurrection, strike, extreme weather, earthquake and natural disaster;

(b) A ship that is unable to dock and prevents You from taking a tour identified and marked as a shore excursion tour type on the site;

(c) A flight cancellation if there are no other means to travel to the destination; and

(d) A “Do Not Travel” advisory issued by the government affecting your travel that may occur after a booking is made.

The following do not constitute Unforeseeable Events:

(a) Illness or injury of a tour participant;

(b) Poor weather;

(c) Change of plans;

(d) Oversleeping.

We may require You to provide verification and/or documentation to confirm that You were unable to take your tour if You request a refund under this provision. You may contact us to check the event is an Unforeseeable Event and that You can provide the required documentation before You cancel any booking.

The Site is protected by copyright, trademark, and/or other laws. All trademarks and logos used on or in connection with the Site are trademarks or registered trademarks of TukTukAthens.

You acknowledge and agree that the Site and all its components, texts, graphics, data, designs, look and feel, photographs, sounds, images, software, videos, and other content, including all associated intellectual property rights (“Proprietary Material”), are the exclusive property of TukTukAthens and/or its licensors or authorizing third-parties, and is protected in all forms, media and technologies. You may not copy, download, use, edit or retransmit any Proprietary Material, in whole or in part, without the prior written permission of TukTukAthens.

We employ the use of cookies. By accessing the Site, You agreed to use cookies in agreement with our Privacy Policy. 

Cookies are used by our website to enable the functionality of certain areas to make it easier for people visiting our website. Some of our affiliate/advertising partners may also use cookies.

The following organizations may link to our Website without prior written approval:

Under no circumstances will TukTukAthens be liable to You for any indirect, incidental, consequential, special or exemplary damages arising from any provision of this Agreement or from the provision of any tours or other services purchased from the Site. Furthermore, the TOTAL liability of TukTukAthens arising with respect to this Agreement and the Site shall in no event exceed the total amounts paid by You to TukTukAthens under this Agreement.

We reserve the right to request that You remove all links or any particular link to our Website. You approve to immediately remove all links to our Website upon request. We also reserve the right to amend these terms and conditions and it’s linking policy at any time. By continuously linking to our Website, you agree to be bound to and follow these linking terms and conditions.

If you find any link on our Website that is offensive for any reason, you are free to contact and inform us at any moment. We will consider requests to remove links but we are not obligated to or to respond to you directly. 

We do not ensure that the information on this website is correct, we do not warrant its completeness or accuracy; nor do we promise to ensure that the website remains available or that the material on the website is kept up to date. 

(a) Waiver. Failure by TukTukAthens to enforce any provision of these Terms and Conditions shall not be construed as a waiver of any provision or right.

(b) Governing Law. The Services are provided by TukTukAthens as described on the start of these Terms and conditions These Terms and Conditions, and all other aspects of the use of the Site, shall be governed by and construed in accordance with the laws of Greece, in Athens, Attica region.

(c) Entire Agreement. Except for any additional terms included in the Site, these Terms and Conditions constitute the entire agreement between You and TukTukAthens with respect to the subject matter of these Terms and Conditions.

(d) Severability. If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions shall remain valid and enforceable to the fullest extent possible and shall remain in full force and effect.

(f) Notice. (g) Litigation Class Action Waiver. To the extent allowed by applicable law, You agree that any proceeding to litigate in court any dispute arising out of, or relating to, these Terms and Conditions, will be conducted solely on an individual basis, and You agree not to seek to have any controversy, claim or dispute heard as a class action or any other type of representative proceeding.

(h) Dispute resolution. You agree that You will attempt to resolve any and all disputes in the least onerous manner. If You and TukTukAthens are not able to resolve disputes by agreement, then You agree to first mediate any dispute between the Parties to be conducted in Athens, Greeece, with mediation fees divided equally between You and TukTukAthens. In the event that litigation is commenced by either You or TukTukAthens, You agree to submit to the exclusive jurisdiction of the courts of Athens, Grece. You agree not to file a complaint or other commencement of litigation more than six (6) months after the relevant dispute arose.

TukTukAthens may modify these Terms and Conditions and its policies from time to time in its sole discretion. If we make changes to these Terms and Conditions, we will post the updated Terms and Conditions on the Site. If You continue accessing the Site and using the Services, then You are deemed to have accepted the amended Terms and Conditions. If You do not agree to the amended Terms and Conditions, You will terminate these Terms and Conditions before the date they become effective, and will stop accessing the Site and using our Services.
